This is a time for public comments on matters not otherwise on the agenda but within the subject matter jurisdiction of the Planning Commission.  Comments shall be limited to 15 minutes, divided among those persons desiring to speak, but no person shall speak longer than five minutes.  Persons wishing to speak on a specific item will be recognized at the time the agenda item is considered.

The City is not responsible for the content of statements made during the public comment period, or the factual accuracy of any such statements.

a.    Staats Reconstruction – Project No. 07-1395-DPM/CUPM/CDP
Planner:  Steve Goggia

Hearing on the request of Barry Horwitz, agent for Steve Staats, to consider Case No. 07-1395-DPM/CUPM/CDP [application filed on May 15, 2009] for review of a Development Plan Modification, Conditional Use Permit Modification and Coastal Development Permit to allow a 960 square foot single story residence to be reconstructed on site under the provisions of the Planned Residential Development (PRD-20) Zone District; and to accept the Exemption pursuant to §15301(d) and 15303(a) of the State Guidelines for Implementation of the California Environmental Quality Act.  An area of approximately 60 square feet of this reconstructed residence would encroach into the front yard setback, necessitating a Conditional Use Permit pursuant to Section 14.82.061 of the Zone Code:  Nonconformance of residential uses as to yards.  The application involves APN 003-305-011, addressed as 4822 Fifth Street.
